barnes. >> good morning, nice conditions throughout, little cool to start the day, temperatures falling back into the 30s and 40s, we're going to slow to warm-up, but eventually the sunshine's going to win out and we're in for a pleasant afternoon and get ready to enjoy temperatures in the 70s. yeah, they'll be back later. let's look at our satellite radar and you'll see the cloud cover across the area. and not much to speak of. cloud cover out to the west and a few clouds overnight. generally sunny to start your day. well out to the west, i want to mention that thunderstorm, out towards iowa and missouri. that's our closest area of rain showers and believe it or not, that's never going to make it in here. we're looking at days and days of sunshine for the week. 55 right now in washington, it is 50 out at zellis. 53 degrees, again cool start to the day, but a very pleasant afternoon with high temperatures top ought in the upper 60s and low 70s and should be nice dry monday for

you. we'll go 72 in washington, 67 in leonardtown. i'll go back up to you. thank you very much. it's a couple of weeks until election day, but starting today, voters in the district will be able to start casting ballots in early voting. dc voters got a chance to meet almost a dozen candidates running for the dc counsel at a forum in northwest last night. >> president obama and governor romney face off one more time in a final time in the formal debate tonight, joining us now with a preview from boca, florida, is the fox business network, good morning. >> reporter: good morning. >> how important is this third and final debate tonight? >> reporter: very important. it's the last pitch to voters. when you think take into account, allison, the first debate largely seen as a romney- victory. the second debate largely seen as a venue for president obama to come back to reassert himself, got that last time, this is the last pitch they

have to make for voters. this has been such a tight election, its gotten closer after the first debate. it's vital these two guys make the pitch tonight and really the lasting venue they'll have going into the election just a couple weeks away. >> you sort of mentioned the first debate and you talked about that, everyone going plop, the second with president obama did, with the town hall debate last time, and i know the format is different now, is that sort of back and forth do you think something that these undecided voters especially to wt see? do they want to see these two men fight like they did last time? >> reporter: it's a good question. something we like to see, but that's the thing about undecided voters, you're not sure whether or not they see that as a projection of power, projection of confidence for both candidates or overbearing and somewhat beneath that of the level of a president. today it's a little bit different, this evening's a bit different. much like the first debate. this will be broken into six

different topics, 15 minutes for eah topic. it's all based on foreign this is snag republicans want to bring back to the economy, and there will be avenues for republicans to talk about the economy. especially when it comes to china, especially when it comes to european debt problems. we'll hear probably an awful lot of a number of different products. >> in past debaits we have seen that avenue if you will from mitt romney, lead down the path of criticism, and how the president and the administration handled the consulate killing. do you expect mitt romney to sort of hammer him on that again or more, i know libya will definitely come up? what might the strategy be here from the governor? >> reporter: well the strategy from the governor, at least republicans say is to have rehearsed better answer than last time. last time he got bogged down with the moderator. this time he's got to have that answer ready to go because there is an opening for

republicans there. they've do see it as a fumbling, at least from the response of the obama administration telling a number of different avenues it could have happened from benghazi, their explanation didn't jive one week after the next republicans say and the way that mitt romney hand that would last week, republicans criticized that said he had a clear opportunity to take advantage of that and didn't do that. governor romney's been preparing in florida. we could imagine he'll have some, somewhat of a better answer this time around. >> quick last question, the president likely to talk about the killings of both muammar gaddafi and osama bin laden? any other advances or victory and that's in quotes that the president needs to hammer home tonight? >> reporter: sure, he'll talk about getting out of afghanistan and iraq. when you look at the poll, the president does have a lead on foreign policy. a lead for president obama. >> rich, fox business network, thank you very much. >> reporter: thanks, allison. >> and just reminder, we have a

new show debuting as election day approaches. fox 5 news you decide 2012 will focus on local and national candidates and issues during the final two weeks of the campaign. it starts tonight at 6:30:00 p.m. of course right here on fox 5. and checking our other top stories this morning, police were out early seeking the public's help in hopes of finding whoever killed 18-year- old markell rs. the high school senior was killed while walking to school back in september. this morning police officers talked with commuters on old central avenue in capitol heights. they believe someone was robbed in that area on the same morning markell ross was murdered and they want to speak with that person. and in montgomery county, police are searching for clues in what they believe was an attempted sexual assault. it happened around 7:00 last night while the 21-year-old victim was jogging on capitol crescent trial in bethesda. >> melanie is live now with the

latest, good morning, melanie. >> reporter: good morning, and certainly a frightening incident for people that live in those neighborhoods and use those trails on a regular basis. you're right, early information montgomery police is that this appears to be an attempted sexual assault. but there are still so many details that need to be filled in. now the capitol crescent trail runs about 11-miles from george do you know to silver springs. it was in the bethesda area near brookway drive, that's south of massachusetts avenue that the attack happened. police say a 21-year-old woman was jogging on the trail around dusk and stopped for a group of deer to pass. she was struck on the head from behind and blacked out. montgomery county police tell us what happened next. >> she awoke, some time later off the trail. was able to get back on the trail, and thankfully, a 40- year-old male jogger was passing by, assisted her to

this address where 911 was called and police arrived. >> reporter: and he is referencing a house there off of brookway drive where the victim and the person who was helping her went to call police. no details so far on the extent of her injuries, we're still trying to get information from police. we know the detectives did interview the victim yesterday. and they're trying to piece together a little bit more information for the public here. they're also reminding people to be careful around this time of year when darkness seems to fall, tony, and annson quicker than we expect. they want to remind people that can creep up suddenly and dark gets earlier, make sure they plan their outdoor recreational activities giving themselves enough time to get home safely before dark. that is the latest from montgomery police headquarters here, back to you. >> good, thank you, melanie. the owner of a day care in prince william county where a baby died earlier this year is expected to plead guilty in court this morning.

this person is charged with a five counts of child neglect related to her day care. little angels of the world. it's in bristo. the ten week old girl died last march, there was foul play in that cause of death. the man suspected of throwing a fire bomb into the food court of annealing ton mall is due in court today. prosecutors say that the 29- year-old is charged with a commit arson for allegedly throwing a molotov cocktail. he was arrested last week, a few hours after the lunch time incident. making headlines this morning, police in wisconsin say the gunman who opened fire at a spa yesterday morning had slashed his estranged wife's tires two weeks before. the woman was granted a restraining order against 45- year-old radcliff. killing three and wounding four others before killing himself

inside the spa. no word on whether his wife was one of the victims. funeral services have been set now for george mcgovern. >> the former senator died yesterday morning after suffering from a number of medical conditions. a public viewing will be held from 1:00 to 6:00 p.m. thursday in sioux falls, south dakota. a prayer service will follow. funeral will be held on friday at 1:00 p.m. private burial will take place later at a later date right here in washington, d.c. mcgovern served three senate terms and ran for president three times. most notably against richard nixon in 1972. george mcgovern was 90 years old. unsuspecting commuters gate chance to unlock the 007 they have in them. you don't to want miss their attempt to score free tickets ahead. speaking of commutes, rough one for dave ross who is live in new jersey, dave. >> reporter: yeah good morning, allison. i'm currently playing off, off,

jersey more than yours truly. okay so we wanted to spend more time coming back to the studio and being with you guys person. we decided to break down on the turnpike so that we could get code to what exit? i think exit five and stay here in west burlington, i don't know where in jersey. we've been looking for the body of jimmy hoffa, have yet to find it. i never realized how much i loved dc until i spent two days in jer write. so for whatever that's worth. the fourth quarter yesterday was superlative. you had two quarterbacks, i was talking to doc walker afterwards in the postgame show. doc and i agree right now, there might not be a bigger play than eli manning. rg3 held his own far guy in his seventh game in the league throwing this 30-yard touchdown pass to moss in the final two minutes, and dining it without a lot of his weapons, i mean pierre hasn't played since week

one and he's supposed to be the money guy. you go to moss whose been become the third guy there. we all know that fred davis went out yesterday, we're going to talk more about that in a moment, to have rg3 perform as well as he did, eli manning on top of what rg3 does, victor cruz, does the dance, he does it all, that place, it was bedlam yesterday, i looked around the crowd, and it was, it was one of almost disbelief the way that they watched the gaming, i think they knew what manning could do, then the giants faithful saw what rg3 could do. there was applause when he was the last guy walking off that peeled. he holds his head up high, guys. there was nothing that says that we're not as good as our counterparts the giants who of course are the defending world champs. so again, they're 3-4, yes, they had four turnovers, yes they had seven penalties, but it was a game with all those

mistakes that the redskins still could have won. >> absolutely right, and they should not hang their head. i'm glad, it's nice to hear and read some of the comments from the giants fans, the giants themselves, even their coach talking about rg3. that's good stuff. now let's talk about the other giants, san francisco giants. >> reporter: yeah, tony, how about this, look, if you liked game sevens and i love a good game seven and hopefully i won't be watching it from the hotel room tonight because i'd like to watch it on fox 5 on 8:00, shameless plug, it doest get better than tonight. the giants down three games to one have comeback in this thing, and now it's three all and they could go on to the world series, the winner take all here to play the detroit tigers come wednesday night game one again on fox 5 on october 24th. so it's as good as it gets, if you like game sevens and hockeys and basketball and baseball, every pitch, it means something. and you just don't get this forever, you don't get this feeling in many other sports.

that's what game sevens bring. i can't wait to see it tonight again hopefully we'll be able to see it as we get back home. it's going to be interesting to see because the giants, the cardinals of the defending champs, the giants won it a couple years ago to two of the very northwest baseball really doesn't get better than that. tony and allison quickly, fred davis, he's gone for the rest of the year with the torn achilles. again chris cooley has to pass the physical today and we believe he'll become a member of the washington redskins. again you have to remember this tony and allison, one of the reasons they cut him in the preseason was chris was not up, physically, to being 100%. i don't know whether or not passing thaphysical is a guarantee. we assume it will be, but it's something to keep an eye out for. again that's one of the reasons they let him go, physically he couldn't do the same things. we have to wait and see on that. it's a big loss because fred davis was rg3's number one target. >> all right, dave ross

an alert for drivers this morning, nissan recalling nearly 14,000 ultimate vehicles for loose bolts that could potentially fall out. increasing the risk of if crash the recall is for model years 2012 and 2013 bank account new ones made from may 10th may 10th through july 26th. the recall is expected again next week and dealers will tighten the bolts to the necessary amount. 163 million workers can expect a big tax increase regardless of who wins the presidential election. a temporary reduction on the social security payroll tax is set to expire at the end of the year. neither president obama nor mitt romney have proposed an extension, and it probably wouldn't pass in congress. someone making $50,000 a year would see an increase of about

project certainly not limited. mgm resorts is spending $8.4 million to get you to vote yes while pen national gaming is putting down $9.5 million for you to say no. are voters really listening? joining us now are two democratic delegates are on opposite sides. lewis simmens opposes it, jay walker is in favor of it. thank you both for coming in, we appreciate it. we're going to show a couple of the ads, before we do that, delegate walker, let me ask you generally speak why are you in favor of question seven? >> first of allowing the people to vote on it. then once you establish that, then you ask yourself, if you fundamentally have a problem against gaming which which are there are some people, they have the right to vote no. you have others that are in favor of gaming and they're saying if we can increase the business tax, why allow $500 million to go out of state when

you can keep the money here, help out our schools and roads, help out the needs of the citizen. they have an opportunity for vote for it. if you are against it like delegate simmens is, you can vote no, but the same time, if you think there's some good out of it, you should do it. the only disturbing thing is making itself cloudy. >> delegate simmens, why are you opposed? >> the the fundamental reason is this is a clever deception that has been promoted and really hoisted on the public by organized gambling and it's apoll gists. they make it seem as if for every casino dollar that comes in, that education fund willing either be increased or stabilized. that's absolutely false. the deception is this, the way the slaw written, is that for every casino dollar that goes into the so-called education trust fund, and e -- an equal dollar is subtracted from the

general fund where's that would have been spent on education. in other words it's a complete wash. so the people who voted for slots for example back in 2008, voted under the same misconception, they thought education funding would be increased or stabilized. this does absolutely nothing to increase education and there are many social ills that i'm sure will speak about which i think outweigh the very small benefit that this would bring to the state of maryland. >> delegate walker, let's talk about that fact because it is a fact, how the slaw written that this money goes in and then money comes out to be spent somewhere else. do you think the ads are misleading about this? >> very much so, mislead being. the law states that the money from gaming in the state of maryland goes to the education trust fund. that's why you see in commercials with you question with any fund in the assembly, lawmakers can move money with the vote, stroke of a pen, that can be done. this is no different. you can take money out to the chest peek bay fund and move it

to pay for law enforcement if you see fit. they're being misleading. it's designed to go to the education trust fund which would bring over $250 million for education funding in the state of maryland. that's the fact, that's the law. they try to make it cloudy and that's why i think it doesn't make a lot of sense when you have those perceptions out there. the money, $250 million is going to the education trust. >> but it's not 250 million additional dollars. >> yes. >> some of the ads make it sounds like it's additional. >> it is. >> somehow it addition if money -- >> question seven generate more money to the current slots we have. longer hours of six site locations, this is more money that's going towards education solely, that's why you get confused there. it's additional money for education trust funds because of the expanded hours, the table games that are being included as well as the shots and billion dollar facility in prince georgia's county. >> your viewers taking away anything from this discussion, it is what my good friend

delegator has said erroneous. this is different, and let me tell you why it's different. for those who wish to check with the baltimore sun own september 6th, 2012 wrote a very, very factual editorial in which they said exactly what i'm saying. here's the way works, education funding in maryland is not governed by this statue. education funding in maryland is governed by a 2002 statue which was called the thornton commission. the formula in that commission determines how much money is spent every year. and this gambling bill does not change the formula in any way. for example, if you're supposed to spend $10 per student, then, and you bring in $3 from gambling, then instead of spending $10 from the general fund, you'll only spend seven. it's a complete wash. it's profounding misleading and this is different than what yay is talk abouting when he says that the legislator generally does raid funds like the

transportation trust fund where we tell people you're going to pay taxes and we're going to build bridges then we take it basically to balance the budget somewhere else. this is different because people are being misled, it really is a fraud when people -- >> you're doing the misleading. that's where the debate comes in. >> when people go out to the polls and think they're going to be increasing education, it is a complete wash, you can independently check this with the department of legislative services, the indianapolis capitol recently came out with an editorial saying that marylanders and their words were being played for suckers. what's as bad as organized gambling is the deception that's being perpetrated. >> that's where the debate comes in. if you have a issue with fundamental gaming, he's been consistent we give him credit for that, at the same time every year, particularly last year, delegate simmens counties came up that said with moe, we're going to get hit with this. we have to raise $79 million to

help fund our formula. if the county was in the same situation, wave shortfall as well. that's where why baker has said this would be good for the business tax base, but we can help fund our education. >> let me ask this, another question or two, i want to try to get a couple in here. and i'll ask you dell georgia walker first, are you, some are concerned that gamabling bringing to prince georgia's county will also bring with it other ills. increases in crime, possible prostitution, etc., etc., which sometimes goes demand hand with these types of facilities. not always, do you have concerns about this? >> sure. i wouldn't be in a position of leadership if i did not have those concerns and if i acted naive to the fact that be these are some of the concernses we have. we've put things in place. we put more money towards gambling addiction than any other state. also the fact that we put in $20 million for law enforcement, 20 million wan five mile radius. if you've been no national

harbor, you'll see it's upscale, upclass, the one thing i feel confident in is people do not allow those activities to take place mr., just in case we did put in safeguards and one other point that's very important to constituents in my direct, there's transportation funding in there. indian head highway route 210, stipulation that gives $15 million a year for the improvement of traffic flow which took me so long to get here this morning. i think those are some of the that i think things that we realize louisiana that, but at the same token, these citizens are going toupees right now, they're gamble, they think going home. while mills is building their tax base and we have nothing show for it. >> we're out of time, let me get you one more word in here, do you take issue with the money going to transportation? >> well, not on the, i do think that the transportation, we don't have money to build that road now. the social and economic ills have been vastly underplayed. our former attorney general governor kern out out a report

several years ago in which he said embezzles, thefts, prostitution, clink sexually abuse family break-up, generally spike when you bring in a casino after a period of time. prince georgia's county and baltimore city already have exponentially high crime rates. very vulnerable communities. we're placing these casinos, and all of the studies point out that it is minorities are african american community latino community that if you put a casino within county, there's a 98% chance that minorities and those who are in the lower socioeconomic ladder are most vulnerable to becoming problem gammenners. the question is this -- >> one more. >> let him finish. >> if this was such a great deal, ask yourself, why isn't virginia which is an economic power house even thinking about slots or casinos? why isn'ting north carolina even thinking about shots or casinos? it's because they believe in

huge, well it's 268,000 square feet, four floors, mechanical penthouse, and if you want no to know one of the people that's responsible for how it all looks and works, let me introduce you to roger, good morning. >> good morning. >> reporter: here we are up on the roof. >> it's a beautiful day. >> reporter: we want to explain to people why we're up here. first i want to talaboutthe design of this building and why sos special. >> we designed it as a series of fluid waves, we wanted to capture the motion in the building. we wanted the researchers to connect to the form of the building and the natural forms day study every day. some people said is resembles rain bands in a hurricane or it's a series of waves or even the wing of a seagull on the noah logo. whatever -- >> reporter: depends on what department they work as to what they see. >> exactly. we to want make sure that a natural systems don't travel in straight lines, the building

doesn't add straight lines, it's a lot of cascading forms. >> reporter: you congressmenned this is probably one of the most green buildings around. talk to me about what that means. >> we have a lot of sustainable features around the building. we wanted the researchers to conne to the natural environment around them as they're doing this research on the weather and the climate. we have green roofs on two- thirds of the roofs of the building, so it's planted roofs as you can see up here. help insulate the building, creates natural habitats for wildlife and it stopped rain water from going into the storm water system. >> there's actually a water fall somewhere? >> there's a five story water fall coming off the building. a third of the roof collects water, when it it's rain, people can see it come down. >> reporter: for you to be a part of a project like this, what does it mean to you career wise but personally? >> it's very rewarding, especially to see it done and be out here and talk with the research mother seem happy with the building, yeah. >> reporter: one of the amaze

things is we are here at the university of maryland. and so, as we head into the future with this building, the partnership that they can have with the university and the opportunity that students can have to be here and work in this facility is pretty amazing. incident introduce you kristy weber, she is a fourth year, fourth because she's in a five year program. she's majoring in aerospace engineering. >> good morning. >> reporter: talk to me about what you think about this facility and the fact that you might get to have access to it. >> oh i think first of all, it's absolutely beautiful. but secondly it's going to provide a lot of opportunities for anything i want to do. i'd really like to get into remote sensing and this building, it's exploding with so many opportunities to do this because you have people doing satellite research, people doing data processing and meteorologists everywhere helping out. >> reporter: do you recall feel like, i mean there is no other place like this obviously in the nation. this is it, this is the center for it all in terms of weather and beyond with noah. for you, to have a right here

we rescue from high kill shelters. it's a great thing for families to do together. i know my kids enjoy having animals in our house, we help get them socialized and healthy and placed in great forever family homes. >> wonderful, look at these two looking at each other. are you okay? i'm okay, are you o.k.? we talked about halloween and safety for our pets safety. we do stories about how the black cats and the dogs especiallying with they already have that stigma as far as getting adopted. there are going to be some jerks who think it's funny to do unfortunate things to our animals. and especially cats, right? can you talk about it. >> right, well, you know, black cats do have the stigma, and you're right around halloween we have to be careful with our animals because unfortunately they are -- there are people who don't have the best intentions. it's important to be careful, you know, with trick or
